A Knox County grand jury has indicted longtime Oak Ridge union leader Carl "Bubba" Scarbrough on two counts of rape and two counts of sexual battery involving a teenage boy.
The indictment made public today charges Scarbrough, 63, with forcing the teenager to "sexually penetrate" him and have "sexual contact" with the boy.
"Were in the process of reviewing the indictment, and Mr. Scarbrough intends on entering a plea of not guilty at the time of his arraignment," his attorney Gregory P. Isaacs said today.
In July, Knox County General Sessions Judge Charles Cerny sent to the grand jury for review a charge of statutory rape against Scarbrough.
Statutory rape is a Class E felony, the lowest level of felony crimes in the state.
But Assistant District Attorney General Willie Harper told the judge that, based on the boy's testimony, she expected a heftier charge to emerge from the grand jury.
"We've clearly established probable cause (for statutory rape)," Harper said at the time, adding that her office would rely on the grand jury to level "a more serious charge."
The preliminary hearing also revealed that the Fort Sanders Health and Fitness Center in West Knoxville, where the alleged statutory rape occurred, had received other unspecified "complaints" about Scarbrough before the June 9 incident.
"She actually gave me a file Mr. Scarbroughs' file," Knox County Sheriff's Office Detective Ray Treece testified about the Fort Sanders' gym manager's reaction to the allegation. "The file had complaints filed previously."
Treece's comments drew an immediate objection from Isaacs, who complained that Treece added that incriminating comment instead of answering the attorney's question. Cerny schooled Treece on being responsive to questions asked of him. The prior complaints weren't filed as part of the court record.
Scarbrough, a decades-long employee of the Y-12 nuclear weapons plant, longtime leader of the Atomic Trades and Labor Council and former Anderson County commissioner, is accused of performing oral sex on a 13-year-old boy in a steam room at the gym.
The boy, now 14, testified that he encountered Scarbrough at the gym on June 9 as he left the steam room and headed to nearby shower stalls. There are no curtains on the stalls.
"I walked into the showers to shower off, and that's when I saw Mr. Scarbrough," the boy testified. "He was facing the wall with his head turned looking at me."
The teenager said Scarbrough was masturbating. The boy felt "uncomfortable" but still had shampoo in his hair, he said.
"I put on a towel and walked two shower (stalls) over," the boy said.
The teenager said he finished showering and then went to the steam room. Scarbrough, he said, followed him.
"Mr. Scarbrough walked into the steam room and closed (the door) very tightly," the boy said. "He kind of forced it shut. That's when I got scared. I could feel something bad was going to come out of this."
The boy said he was sitting down. Scarbrough was standing next to him and began masturbating as he quizzed the teenager.
"He asked me how old I was," the boy testified. "He asked me if I had a boyfriend."
Scarbrough then sat down next to the boy and "told me to" fondle him, the boy testified. The boy said he complied "because I was scared."
"He told me to stand up," the boy said. "I stood up."
"What happened?" Harper asked.
The teenager froze on the witness stand, blinking his eyes and appearing to fight back tears. Harper then walked toward him and whispered to the teenager, who blurted out that Scarbrough had performed oral sex on him.
The boy said the encounter lasted "maybe 12 seconds." He testified that he left the steam room, dressed and then went in search of his mother.
Treece said he was summoned to the boy's house after the boy's mother phoned authorities. He interviewed the boy and then went to the gym.
Isaacs hammered Treece with questions about the detective's investigation. He questioned why Treece had not gone into the steam room or the shower area on his initial visit to the gym.
Isaacs repeatedly pointed out that the gym is usually crowded in the afternoon. The alleged crime occurred between 2 p.m. and 2:30 p.m., but Treece did not find any witnesses who saw the alleged crime or saw the boy and Scarbrough in the same area, Isaacs argued.
Three weeks after his arrest, Scarbrough announced that he was retiring from his Y-12 post. The ATLC placed him on paid leave pending further investigation. He remains free on bond. It could be several weeks before a grand jury hears the case.

I don't understand how a physically violent act like this could be judged to be a low class felony. Bodily harm acts are the worst kind IMO.
Their goal is to get a child and sodomize them. That is their perfect fantasy. Just read up on NAMBLA and then make up your mind. The people that say they are just like everybody else, don't know what they do when the door is locked. Put them in positions of power and you will get the same result every time.
This man is a sick creep for taking sexual advantage of this young boy! I hope the jury chooses to convict him a the more serious charges!
the gym on my campus is roughly 1/2 gay at any given time...
well, it's become a little annoying.
I've found that early mornings are about the only time one can actually work out, without interrupting the gay flirting/dating scene.
I could care less if they're gay, but why do they have to gay up my gym, for crissakes?
Feel free to go to the gay bar or local theater group and be gayer than a pink chihuahua in a rainbow handbag, but for the love of Pete, use public facilities for their intended purpose!
Public Parks are for kids to throw rocks at animals, public bathrooms are for usin' the toilet while holding your breath, and gyms are for attending once a week and telling yourself that you've made a difference in your gut.
That goes for everyone. Straight, Gay, European...everyone!

Ill have to disagree thier sending a gay man to prison will not be a punishment it will be a buffet.
