Rendell decides not to delay computer work on gun sales database

Associated Press

HARRISBURG, Pa. --Gov. Ed Rendell, despite pressure from gun dealers, decided Tuesday not to delay a database upgrade that will halt Pennsylvania firearms sales for three days.

The Democratic governor said the shutdown to allow work on the criminal history database would last one day less than previously announced. The Pennsylvania Instant Check System will be down from 6 p.m. Sunday and return to operation at 6 p.m. Sept. 5.

"It is clear that there will never be an ideal time to temporarily shut down the system so we can make changes necessary to ensure the system continues to be safe and useful," Rendell said in a written statement issued late Tuesday.

State police notified gun dealers of the computer work earlier this month, but the issue came to the fore after lawmakers who head the sportsmen's caucus wrote Rendell to protest, particularly because it coincided with the first few days of dove and Canada geese hunting season.

Gun dealers who have sued to block the shutdown said their legal action will proceed as scheduled. A hearing in Commonwealth Court is scheduled for Friday morning.

George Romanoff, one of the dealers who filed the lawsuit, said Rendell's decision did not surprise him. He noted that the computer work was not designed to be done at night, which opponents have said would reduce the impact.

"There might have been more expense to it, but the concerns of dealers obviously do not take front stage with the Gov.'s Office," he said.

A panel Rendell asked to study the issue suggested either a transition that would not interrupt service at all or shutdowns in October or early January. Those options either conflicted with other scheduled computer work or were too costly, Rendell said.

State police operators will accept calls while the system is down, but checks will not be processed during that period.

The system, which uses 1981 technology, provides criminal background information for schools, courts, federal agencies and local law enforcement.

If anyone thinks backgroud checks don’t turn a right into a privilege, this ought to convince them. At the touch of a button, no more transactions.

The gun dealers should have joined a class action suite along constitutional grounds, and demanded an injunction until the courts have determined the constitutionality of this.

I will say, that I cannot support the NRA because they stand by and allow one more gun law after another to be enforced without finding a proxy to support for a Supreme Court showdown.

One day I envision the NRA with hundreds of thousands of members, none of which own a single gun.

Parker v. Washington D.C. in HTML courtesy of zeugma. The NRA supported Parker et al. in the appeal. They started to support Parker et al. in the District Court, but they had a falling out with the other lawyers. Parker v. Washington D.C. has been renamed Washington D.C. v. Heller, Heller being the only determined to have standing, if SCOTUS decides to grant "cert."

The NRA has been co-opted by the gun grabbers and people who think the 2A is about duck hunting. Join GOA if you haven’t already. It’s seriously committed to “no compromise”, and doesn’t spew out reams of expensive full color literature about “sport” and “hunting”.

Bull biscuits. The reason that programmers and system administrators have red eyes and pale skin is that this sort of work is always done at night. The Guv is blowing smoke.

So, Rendell thinks he can affront Pa gun-owners with impunity, eh?

So yoiu’re saying that GOA has been more effective than the NRA in changing Rendell’s mind on this?

The Bill of Rights:

Amendment 2

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

I suppose a slick lawyer like fasteddie will now redefine the word INFRINGED to suit his own agenda!

Was there a good logical reason?

When did Rendell care about the U.S. or PA Constitution?

Rendell, enemy of gun owners’ rights, is testing the opposition and its resistance.
Let me put a pillow over your face, Patient Ed. It’s only for a moment, and it’s just a soft pillow, see? It won’t hurt or smother you, it’s only for four seconds. You’re just irrationally nervous about it because you’re in six-point restraints and on life support at the mercy of many machines, tubes, regulators and monitors. All right, I’ll make it a three-second pillow instead of a four-second pillow, now you feel better?

I totally agree with you. When the NRA gives a B rating to Romney for his signing of a PERMANENT AWB when he was Gov. of Massachusetts, it is time to evaluate the NRA's relevance to our rights.

The union zombies voted this thug into office twice!!Here in PA they love politicians who raise every fee and tax they can get their hands on. Rendell need not fear. If he runs for a third term he will win it easily.

It already has, from Lady Lawyer, a Romney supporter, on FR to me dated 08/12/2007 12:16:44 PM EDT No constitutional rights are absolute. All are “restricted” in some way

In the same thread she posted, I am not a liberal. I don’t believe that the constitution is fluid. I am simply stating a fact. At some point, each constitutional right runs into a reality that requires anyone with common sense to say that here is a “limitation.”

She is just another RINO out to shred the Constitution.

Rendell is hopeless (and not just on this issue), but GOA is much more likely than the NRA to convince enough PA voters to dump state legislators who promote/allow this crap. GOA mainly focuses on national offices and federal legislation at this point, but with more contributing members, it would have the capacity to be more active at the state level. The NRA’s intense promotion of the idea that the main reason to have a gun is for “sport” reinforces the already widespread notion that there’s nothing dangerous about registration schemes. Who cares if the government knows what toys you have?

I wish the gun dealers — ALL Pennsylvania dealers working together — would simply, with public notice, announce they that will be selling as usual during this period, and that if the governor wants the sales run through the background checker, it’s up to him to make sure it remains operational. If anyone gave them (and/or any buyers) any trouble about this, it would set up a very nice federal case, since it’s pretty clear that outlawing all gun sales in an entire state for any period of time is an “infringement”, and attempting to pull the licenses of, or impose significant fines on all dealers in the state for refusing to comply with such an outlawing would get the full attention of pro-RKBA forces.

The GOA is useless. They have never accomplished a single thing.

If you doubt that, name a single thing they have done on their own.

I have to wonder how many ‘stay at home voters and we’ll show you’ are begining to wonder what wrong they did?

I sure hope they are proud to let the libs run this state, the congress and the senate, the libs are really stirring everything up and us pubbies are just sitting around....

What to do?

Start with voting every dirty, cheating, stealing lib out of office, and that would let the pubbies run everything for once!
