[Mass] Senate passes repeal of 1913 marriage law [re: gay marriage]

The Massachusetts Senate today passed a bill that would repeal a 1913 state law that prevents gay and lesbian couples from most other states from marrying in Massachusetts.

The bill, which had the support of Senate President Therese Murray, passed with no objections on a voice vote. Proponents of the repeal called the 1913 law archaic and discriminatory.

"There are very few laws on the books that I can say that I'm ashamed that they're on the books," said State Senator Mark Montigny, a New Bedford Democrat. He said he opposed the law because of the "immorality of discrimination."

"This is a very simple law, contrived in shame, and it exists in shame and we ought to wipe it off the books," he said.

"The 1913 law is a shadow, a terrible shadow. It represents a segregationist past that is best put to rest and put to rest quickly," said Senator Harriette Chandler, a Worcester Democrat.

The law originated when lawmakers in many states were trying to prevent interracial couples from crossing state lines to marry. It fell into obscurity for decades. But it received new attention in 2004, when Republican Governor Mitt Romney invoked it after gay marriage was legalized in Massachusetts to prevent out-of-state gay and lesbian couples from marrying here and forcing their home states to consider recognizing Massachusetts marriage law.

“The Massachusetts Senate has no right to infringe on the internal issues of how other states define marriage but that’s exactly what they voted today to do,” Kris Mineau, president, Massachusetts Family Institute, which opposed the repeal.

The bill now heads to the House, where Speaker Salvatore F. DiMasi has already expressed support. Supporters said they expected the bill to pass the House and be signed by Governor Deval Patrick by the end of the month.

I have an idea: All the so-called blue states that want to can join Canada, the red states remain the USA and any Canadian provinces that wish can join us. Fair? That way, the liberals get that vaunted “free” healthcare they’ve been clamoring for, and both go their own way...

I swear everytime you think Massachusetts can’t do anything else to look more kooky, they find something. It feels like they’ve run out of far-left nut causes a long time ago, but they just keep chugging along.

They got the healthcare thing, the strict gun control laws, the proposed spanking ban, gay “marriage”, etc., etc., etc.

At this rate they’ll propose legalizing full public nudity anywhere, any time and any place next year.

Every year the Massachusetts legislature finds and does something to keep most of the rest of America laughing. They WILL find something next year, bet on it.

Can anyone identify any society which has survived for at least 1,000 years with a population of at least 1,000 people, that has not regarded a marriage as a union involving exactly one male? I know there have been some societies that practiced polyandry, but such societies are extremely rare.

What do liberals know that billions and billions of people through the ages have not? Never, at any time or on any continent, or among people of any religion or no religion, has marriage ever been widely recognized as involving any other number of males.

Romney’s plan has succeeded.

Since Romney did not support repeal of this law, that statement is unfair and inaccurate. Romney also opposed same sex marriage. Of course he did implement the court ruling, but there are other constitutional considerations about the executive refusing to enforce a judicial decision. Perhaps he should have disobeyed the court ruling, but complying does not mean that he supported the court ruling.

Actually, about a third of the electorate consistently votes somewhat conservatively, but it is not enough to make a difference sadly.

forbade the Court from their decision as you say.
Romney should have done nothing.
Instead, Romney ignored the Constitution and
cowardly demanded that the Clerks obey the illegal order.

But for Romney, nothing would have happened.
Therefore, Romney must share responsibility,
rather than play victim, as he does over and over.

Yep, and don't forget the Portuguese and French Canadian "cultural Catholics" in MA as well.

We have the same phenomenon here in NJ. 40% of the population identifies as "Roman Catholic", yet I'm willing that bet that barely half of those attend Mass on a regular basis, or listen to the Magisterium.

I am a non-believer, but respect those who are TRUE to their faith, rather than having a mere ethnic social club.

No, they don't, and it's an utterly absurd comparison.

The rap on civil rights was always that you can't penalize someone for something they were born with...like race.

What I meant was those folks who claim to be Catholic “because they are Polish.” I did not mean literal ethnic social clubs. I myself attended the Polish Falcon (now a Portuguese catering hall) in Newark with my Grandfather and uncles when I was a little boy.

As a conservative I believe less law is always best for the people, without exception. The less intrusion by the government into our lives especially under the guise of big-brother the better for everyone.

I personally applaud their move, now if we could continue to get rid of the laws that hinder free citizens in their personal lives and pursuit of happiness this country just might survive another 100 years.

Solomon was such an evil guy, wasn't he.

The notion that a marriage consists of one man and one woman is very widespread, but I would say it falls slightly short of being universal. There have been and are today some societies where polygyny is accepted. By contrast, I am aware of no societies of significant size or endurance where a marriage does not consist of exactly one man and at least one woman.

Also, the Bible, especially the New Testament, clearly favors monogamy, but I'm not aware of any particular condemnation of polygyny. Indeed, from what I recall of Leviticus, a married man who sleeps with a virgin (not his wife) would be compelled to marry her unless her father refuses. While clearly men are not supposed to sleep with virgins to whom they are not married, it would seem that a married man who did so would be compelled by law to become a bigamist.

And to add insult to injury, the more you read about the wonderful history of Massachusetts and those great men who contributed to the founding of this nation, the more you are disgusted by the current state of politics here.
